Why have Trump and his many Collaborators not been charged with Conspiracy to overthrow the Government of the United States?
Aren’t they publicly declared and active Domestic Terrorists?
I’m serious. Given the incredible latitude that Trump is getting and the liberties he and his allies are taking to publicly plan his ascent to absolute power and the dumping of our Constitution into the trash bin of history, when exactly does the definition of “Domestic Terrorist” finally get applied to him and fellow conspirators by the Justice Department?
Trump has already once publicly teed-up and incited an assault on Congress where, by hours of inaction in the face of the massive violence being broadcast into our living rooms, he demonstrated his intention and hope that the assault would succeed and that he would be able to defy the Constitution and remain in power.
He and his collaborators have also already publicly mounted a broad-based assault on our Constitutional system that went far beyond the assault on the Capitol and challenged the very basis of our democracy — our electoral system and its integrity —in many states and nationally in attempting to undermine and/or illegally manipulate the electoral college.
Every day, sometimes many times a day, Trump publicly declares his various intentions and planning to unlawfully utilize national and state police and military authorities to detain, deport and otherwise neutralize or eliminate perceived political, media, military, judicial, and other enemies. His lawyers just this week argued in open court that he should have such absolute immunity from our legal system that he should not be prosecuted even if he were to have political rivals assassinated.
Additionally, Trump’s collaborators and fellow conspirators have very publicly developed and published their plans to assume absolute executive power, some of which plans have been widely publicized as “Project 2025.”

Project 2025 is a plan to reshape the executive branch of the U.S. federal government in the event of a Republican victory in the 2024 U.S. presidential election.[2][3] Established in 2022, the project seeks to recruit tens of thousands of conservatives to Washington, D.C., to replace existing federal civil service workers it characterizes as the "deep state", to further the objectives of the next Republican president.[4] Although participants in the project cannot promote a specific presidential candidate, many have close ties to Donald Trump and the Trump 2024 presidential campaign.[5] The plan would perform a swift takeover of the entire executive branch under a maximalist version of the unitary executive theory — a theory proposing the president of the United States has absolute power over the executive branch — upon inauguration.[6]
Trump, as President, has also already demonstrated his threat to national security with his open contempt for democratic process and for pro-democracy leaders, allies, and alliances — all while while he forged close, friendly, personal connections with many of the world’s tyrants, like Russia’s Vladimir Putin and North Korea’s Supreme Leader, Kim Jong Un.
Trump has also openly defied and declared his contempt for much of our judiciary and our judicial system. Again, just this week in open court, her lashed-out at a federal judge and the US Attorney General as corrupt, politically motivated enemies.
Where in our Constitution does it provide that formal mechanisms of democracy can legitimately be used to effect a broad, imminent, ongoing (after failing the first time) conspiracy to eliminate the substance of our democracy by seizing power, selectively reinterpreting, suspending, or altogether trashing the Constitution, and recasting America as an autocratic, non-democratic state?
Didn’t we fight a Civil War over such basic threats to the integrity and very existence of our still fledgling Constitutional/Democratic Republic? Aren’t we, some 160 years or so later, still a relatively fledging Constitutional/Democratic Republic? Haven’t Trump and his allies, just like the original secessionists, publicly seized upon formal legal (as well as illegal) mechanisms to go rogue and to reject and recast our nation from a Constitutional to an Autocratic Republic?
160 years later, is our Constitutional Republic no longer worth fighting for?
So, please, will the constitutional scholars and historians among us describe what line Trump and collaborators have yet to cross before he and they can be charged as domestic terrorists and/or with sedition for conspiracy to overthrow the government of the United States, for collaborating with our enemies, and as an imminent threat to national security?

There is no line - it has been erased. Sad and frightening, but true.
You express so well what has been gnawing away at me for some time. Trump and his inner circle of enablers are indeed domestic terrorists. When will Congress address this clear threat with domestic terrorism legislation? Unfortunately it is not a priority and must cede to impeaching Biden and the head of Homeland Security.
